WHAT IS ARBITRATION?
Arbitration is a form of alternative dispute resolution. A third-party expert reviews the malpractice case and imposes a legally binding decision. Arbitration hearings usually consist of the arbitrator, the physician and the physician’s lawyer, and the plaintiff and plaintiff’s lawyer. Arbitration is different from mediation because unlike a mediator, an arbitrator is not trying to find middle ground between two parties.

WHY DOES FAIRWAY USE ARBITRATION?
The two fundamental reasons Fairway uses arbitration are:
  1. Arbitration dramatically reduces the time it takes to settle a malpractice case. This reduces the cost of legal fees and other financial resources.
  2. Awards to plaintiffs are determined by merit, not by an emotional jury persuaded by a highly skilled lawyer.
